Terms & Conditions (KOMFY)
1. Definitions
In these Terms & Conditions, “KOMFY” is referred to as the seller and the customer as the buyer. Together referred to as the “parties”. The “agreement” refers to the purchase agreement between the parties.
2. Applicability
These Terms & Conditions apply to all offers, orders, agreements, and deliveries by KOMFY. Deviations are only valid if agreed in writing.
3. Prices & Payment
All prices include VAT and applicable taxes. Full payment is required at checkout.
KOMFY reserves the right to refuse or cancel orders in case of suspected fraud or payment issues.
In case of late payment (if applicable), statutory collection costs may be charged in accordance with Dutch law.
4. Orders & Offers
All offers are non-binding unless stated otherwise. Delivery times are indicative and do not entitle the buyer to compensation or cancellation in case of delay.
5. Shipping & Delivery
Orders placed Monday–Friday before 16:00 CET are shipped the same business day.
Estimated delivery times:
- Netherlands & Belgium: 1–2 business days
- EU: 2–7 business days
- Uk & US: 5–14 business days
Delivery times are indicative and may vary due to external factors.
6. Shipping Rates
- NL, BE & DE — €5.95
- Europe — €9.95
- UK — €9.95
- USA — €14.95
Free shipping applies on orders over €60 for the Netherlands, Belgium, and Germany.
Customs duties, import taxes, and additional charges outside the EU are the responsibility of the customer.
7. Right of Withdrawal (Returns)
Customers may withdraw from their purchase within 14 days after receipt, provided the return is registered within this period via info@bykomfy.com.
Returned items must be:
- Unworn, unwashed, and in original condition
- Including all original tags and packaging where reasonably possible
- Free from odors, stains, or signs of use
Return shipping costs are borne by the customer unless otherwise stated.
8. Refunds & Exchanges
Once returned items are received and inspected, refunds are processed within 1–3 business days via the original payment method.
9. Risk & Liability
Risk transfers to the customer upon delivery. KOMFY is not liable for indirect damages unless caused by intent or gross negligence.
Liability is limited to the amount covered by KOMFY’s insurance, if applicable.
10. Complaints
Complaints must be reported as soon as possible with a clear description. After processing or use of goods, complaints are no longer accepted.
11. Retention of Title
All delivered goods remain property of KOMFY until full payment has been received.
12. Force Majeure
KOMFY is not liable for delays or failure due to circumstances beyond its control, including but not limited to: strikes, transport issues, supplier delays, government actions, or natural disasters.
If force majeure continues for more than 30 days, either party may terminate the agreement.
13. Intellectual Property
All designs, content, and materials remain property of KOMFY and may not be copied, distributed, or used without written permission.
14. Governing Law
Dutch law applies exclusively. Disputes will be submitted to the competent court in the Netherlands where KOMFY is established.
